On October 1, 2011 The Federal Reserve System Board of Governors adopted the final implementing rules of the Durbin Amendment to the Electronic Funds Transfer Act of 1978. The Durbin Amendment was a part of the sweeping financial reform bill known as the Dodd-Frank Wall Street Reform & Consumer Protection Act as passed by Congress during 2010, in response to the 2008 financial crisis during the Obama administration. As an addendum under the newly revised Electronic Funds Transfer Act, the Durbin Amendment of 2010 formally goes under the name titled section “§ 920. Reasonable Fees and Rules for Payment Card Transactions.” In general, it establishes the foundational basis for merchants being able to provide customers utilizing an alternative form of payment an in-kind incentive or discount, from the stated regular price in accordance with local State & Federal guidelines.
